Copyright in Pakistan isn’t a single, all-or-nothing right – it’s a bundle of exclusive rights (reproduction, distribution, public performance, and more) that can be sold or transferred separately. If you’re buying or selling any part of that bundle, IPO Pakistan requires the transfer to meet specific legal formalities before it’s enforceable, and the transaction should be recorded using Form-III.
What “Transfer of Copyright” Actually Means
Per IPO Pakistan’s own Copyright FAQs: “Any or all of the copyright owner’s exclusive rights or any subdivision of those rights may be transferred, but the transfer of exclusive rights is not valid unless that transfer is in writing and signed by the owner of the rights conveyed or such owner’s duly authorized agent.” In plain terms, a verbal agreement or an informal handshake deal to hand over copyright – even a specific slice of it, like just the reproduction right or just the right to publicly perform a work – is not legally valid. It has to be in writing and signed by the person giving up the right, or by their authorised agent.
This matters because copyright doesn’t have to be transferred as a whole. An author or owner can assign just the right to reproduce a work while keeping the right to publicly perform it, license one right for one territory and sell another right outright, or split rights between different buyers entirely. Each of these needs its own written, signed transfer document to be valid.
Who Can Assign Copyright
According to IPO’s FAQs, copyright ownership can rest with the author, the copyright claimant (someone who has obtained ownership of the author’s rights by contract, such as an employer under a work-for-hire agreement), or the owner of a specific exclusive right, since individual rights can be owned and transferred separately. Any of these parties – or their duly authorised agent – can execute a written assignment.

To record a copyright assignment with IPO Pakistan, you’ll generally need:
- The written, signed assignment deed identifying the work, the rights being transferred, and both parties.
- Details of the original copyright registration (if the work was previously registered), or a description of the work if unregistered.
- Form-III completed and filed with the prescribed fee at the Copyright Office.
Since copyright protection in Pakistan arises automatically on creation and registration is not mandatory, you can assign copyright in an unregistered work too – but if the underlying work is registered, recording the assignment keeps the Copyright Register accurate and gives the new owner documented proof of title.
Why Bother Recording It With IPO
A private assignment agreement is legally valid the moment it’s signed, but recording it with IPO creates an official, searchable record of who currently owns which rights. This matters most when a work changes hands more than once, when a buyer needs to prove ownership to a publisher, distributor, or court, or when royalties and licensing income depend on being recognised as the rights holder. Without recordal, you’re relying entirely on a private document that other parties – and the copyright office itself – have no visibility into.
